Le gouvernement fédéral estime que l’incarcération de certains étrangers au pays pour une durée illimitée est une pratique juste même si elle n’est pas parfaite. Des défenseurs d’immigrants en détention qualifient au contraire d’anticonstitutionnelles de telles pratiques en Cour fédérale, parce qu’elles sont cruelles et contraires à la charte et aux conventions internationales.

National Post – Number of Asylum-Seekers Crossing into Canada Declines in April, but Still Triple the Number Arrested in January

The number of asylum-seekers arrested by the RCMP after making irregular border crossings into Canada declined slightly in April from the month previous, though it was still close to three times higher than the number arrested in January. A total of 859 asylum-seekers were arrested in April, down from the 887 irregular border crossings recorded in March, but up from 315 in the first month of 2017.

A Liberal election promise to overhaul the way asylum claims are handled has been postponed indefinitely despite increased numbers of people seeking refuge in Canada putting the system at risk. Those advocating for the government to do something before backlogs threaten the integrity of the system say they are running up against a Liberal government seeming to have lost interest in spending any more money or political capital to help asylum seekers.

Canada’s immigration regime allows for indefinite and arbitrary detention that can cause severe psychological distress and is therefore unconstitutional, Federal Court heard Monday. What’s needed is a robust process and legal limit on how long foreigners can be held when speedy deportation is unlikely, court was told by lawyers for a Jamaican man who spent five years in custody.
